DRAFT — operator details and legal review pending
This is an English draft pending completion of the operator details and legal review. Mandatory consumer rights under applicable local law are not limited by this document.

1. Who we are, and acceptance

These Terms govern your use of the Camino GO mobile application and related services ("the App"), operated by [LEGAL ENTITY NAME], [ADDRESS] ("we", "us"). Contact: support@caminogo.app.

By creating an account or using the App you accept these Terms. Our Privacy Policy explains how we process personal data; accepting these Terms is not blanket consent to all data processing. You must be at least 16 years old.

2. What the App is — and what it is not

Camino GO is a planning and companion tool for walking the Camino de Santiago: offline maps, route information, accommodation and point-of-interest data, trip planning, walk tracking, community features, and AI-assisted tools (translation, menu reading, photo questions, daily route briefings).

The App is not:

In an emergency, call 112 (EU-wide emergency number).

3. Safety disclaimer (please read carefully)

Long-distance walking involves inherent risks, including weather, terrain, traffic, and health hazards.

  1. Route, accommodation, and POI data can be outdated or wrong. Trails change, businesses close, fountains run dry, opening hours vary. Verify critical details locally before relying on them.
  2. Weather information and warnings are informational. They are sourced from third-party providers and may be delayed or inaccurate. Always consult official meteorological alerts (e.g., AEMET, IPMA) in extreme conditions.
  3. AI-generated advice (including the daily route briefing) is informational only. It is generated automatically from data that may be incomplete. It is not professional, medical, or safety advice.
  4. You are responsible for your own safety: your fitness, equipment, water and food planning, and the decision to walk, rest, or stop each day.

4. AI features — accuracy and allergens

  1. AI features (translation, menu reading, photo identification, chat, briefings) use large language models and may produce incorrect, incomplete, or misleading output, including mistranslations and misidentified dishes, ingredients, prices, or rules.
  2. Allergy and dietary information is never guaranteed. Menu analysis (including vegetarian/vegan/pork/alcohol indicators) is an automated best effort from a photo. If you have an allergy or strict dietary requirement, always confirm directly with restaurant staff. We accept no liability for reliance on AI dietary output to the extent permitted by law.
  3. AI output does not represent our views. You are responsible for how you use it.
  4. You must not use AI features to generate unlawful content or to attempt to extract other users' data.

5. Accounts

You are responsible for your account and for keeping your sign-in method secure. You must provide accurate information. We may suspend or terminate accounts that violate these Terms (§9).

You can delete your account at any time in the App (Settings → Delete account).

6. Purchases, Trip Passes and AI uses

Purchases are processed by Apple App Store or Google Play, with entitlements managed through RevenueCat. The purchase confirmation shows the applicable price and taxes. Passes and add-on packs are one-time purchases and do not automatically renew.

30-day Trip Pass30 per day while active30 minutes per day while active
150-use add-on pack150150 minutes
300-use add-on pack300300 minutes
  1. Pass validity and daily reset. A Pass starts on activation. Another Pass purchase adds the purchased duration to remaining continuous Pass time. Daily allowances reset at 00:00 UTC, not at your local midnight or 24 hours after purchase. Unused daily allowances do not carry over. The Pass expiry shown in the App still applies; crossing midnight does not extend its duration.
  2. One successful submission uses one AI use. Within the metered Camino AI question and translation features, each successfully completed text question, photo question or submitted translation uses one allowance. Sending another question in the same conversation also uses one. There is no separate follow-up bundle. A failed AI answer does not consume an answer use; any temporary reservation is released or refunded.
  3. Recording has a separate allowance. Each cloud recording is limited to 30 seconds. Actual cloud-recognition time is charged to the speech allowance. Re-recording can consume more of that allowance even when you do not submit the recognized text as an AI question. Successful transcription is not undone by cancelling the later question or by a later AI-answer failure. Operating-system speech recognition in face-to-face translation does not use the cloud speech allowance; submitting its text for translation uses an AI use.
  4. Add-on allowances. You do not need an active Pass to use a purchased pack. Purchased AI uses and the associated cloud speech allowance do not expire with a Pass and are not reset each day. Daily Pass allowances are used first where available; purchased balances cover further eligible use. The App displays available balances.
  5. Free uses and contributions. New accounts receive 10 AI uses, without cloud speech minutes. Eligible community contributions can earn additional AI uses under the reward rules displayed in the App. Contribution daily limits reset at 00:00 UTC. AI uses have no cash value and cannot be transferred or exchanged for money.
  6. Availability and abuse prevention. A feature requires sufficient allowance for the requested operation. Technical rate limits may apply to protect the service. Restrictions for suspected abuse are subject to proportionate review and the appeal process in §8; ordinary use of the purchased allowance is not, by itself, abuse.
  7. Refunds and EU/EEA withdrawal rights. Statutory consumer rights and applicable Apple/Google refund procedures remain available. Immediate delivery does not automatically remove every withdrawal right. Where law permits loss of a withdrawal right for digital content, the required prior express consent, acknowledgment and confirmation must be obtained. Digital services are subject to their applicable withdrawal rules. These Terms alone do not constitute those separate consents.
  8. Changes to prices or future offerings do not reduce allowances already purchased. If the App displays a different offer, its specific quantities and validity must be shown before you confirm that purchase.

7. User-generated content (UGC)

  1. You retain ownership of content you post (messages, posts, photos, diary entries).
  2. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display your content as needed to operate the App (including moderation and backups). For content you post publicly, this includes display to other users. This licence ends when the content is removed from the service, except for limited backup or legal-retention copies described in our Privacy Policy and the contribution licence in §7.3. For public contributions retained after account deletion as described below, it continues only as needed to display and maintain those contributions until their removal. On account deletion, the content of your forum topics and discussion comments is removed, including attached forum images, location details, and poll options. Deleted-content placeholders preserve replies written by other people. Other public contributions, such as bulletins, currently remain attributed to "Deleted pilgrim"; you may request removal as explained in our Privacy Policy.
  3. Community data contributions (e.g., corrections to accommodation or POI information, reports of closures) may be merged into the App's database. This does not remove your statutory personal-data rights. For these factual contributions you grant us a perpetual, irrevocable, royalty-free licence to use, adapt, and redistribute them as part of our dataset, so the improved data can keep serving other pilgrims after you leave.
  4. You must have the rights to what you post. Do not post content that is unlawful, infringing, harassing, hateful, sexually explicit, violent, deceptive (including fake reviews), or that discloses others' personal data without consent.

8. Content moderation

  1. Public content may be screened by automated systems (including OpenAI's moderation service) and may be automatically hidden, blocked, or removed if it appears to violate §7.4.
  2. Users can report content in-app. We review reports and may remove content or restrict accounts.
  3. Appeals: if your content or account is restricted and you believe this is a mistake, contact support@caminogo.app. A human will review the decision and reply with reasons.
  4. We are not obliged to monitor all content and are not responsible for content posted by users, to the extent permitted by law.

9. Acceptable use

You must not:

Violations may result in warning, feature restriction, or account termination. Where lawful and proportionate, we will state reasons and you may appeal (§8.3).

10. Intellectual property and data attribution

  1. The App, its design, software, and curated database are protected by intellectual-property rights owned by us or our licensors.
  2. Map and place data include information from © OpenStreetMap contributors, licensed under the Open Database License (ODbL). Attribution and licence details are shown in the App (Settings → Map data sources).
  3. Weather data provided by WeatherAPI.com. Other data sources are credited on the Data Sources page.
  4. We grant you a personal, non-transferable, non-exclusive licence to use the App for personal, non-commercial purposes.

11. Availability

We aim for reliable service but do not guarantee uninterrupted availability. Offline features depend on data you downloaded beforehand. AI features additionally depend on third-party providers and connectivity, and may be degraded, rate-limited, or temporarily unavailable. We may modify or discontinue features with reasonable notice where feasible.

12. Liability

  1. Nothing in these Terms excludes or limits liability that cannot be excluded by law, including liability for intent or gross negligence, for death or personal injury caused by our negligence, or your statutory consumer rights and guarantees.
  2. Subject to §12.1, we are liable only for damages caused by breach of essential contractual obligations, limited to foreseeable damages typical for this kind of contract, and our total liability is capped at the greater of (a) the amounts you paid us in the 12 months before the event, or (b) €50.
  3. Subject to §12.1, we are not liable for: decisions you make based on App content or AI output (see §3–§4); user content; third-party services (App Store, Google Play, accommodation providers you contact); or loss of data you failed to back up where the App offers export.

13. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access for material breach of these Terms, with prior notice and reasons where reasonably possible. §7.3, §10, and §12 survive termination. On termination, unused purchased AI allowances or remaining pass time will be refunded pro-rata only if termination was not caused by your material breach; statutory rights remain unaffected.

14. Changes to these Terms

We may update these Terms for legal, security, or functional reasons. Material changes will be announced in-app at least [14] days before taking effect. If you do not agree, stop using the App and delete your account before the effective date.

15. Governing law and disputes

  1. These Terms are governed by the laws of the Republic of China (Taiwan), excluding its conflict-of-law rules. The competent courts at our registered office in Taiwan shall have non-exclusive jurisdiction.
  2. If you are a consumer in the EU/EEA, you additionally enjoy the mandatory consumer protections of your country of residence, and may bring proceedings in your local courts.
  3. EU consumers can find information about available consumer dispute-resolution bodies through the European Commission's Consumer Redress portal. Participation obligations depend on applicable law; nothing here restricts access to courts or mandatory redress mechanisms.
